This form is recorded by a surviving spouse in order to remove the name of a deceased spouse from a deed evidencing ownership of Arizona real estate.  In order to be effective, the current vesting deed must expressly state that the property is held as "community property with right of survivorship." 

The affidavit must include an attached certified copy of Certificate of Death (with the deceased person's social security number blacked out or covered).  

The affidavit must be recorded in the county where the property is located.  The recording fee is determined by contacting the local county recorder office or searching its website.  The current recording fee in Pima County, including postage cost, is $10.
